Royal Oak, MI Noise from Specific Sources: Delivery Truck Noise (2026)

Section 278-36, Disturbances of the peace by trucks, in the Royal Oak City Code's Disorderly Conduct chapter, imposes three overnight restrictions. Subsection A makes it unlawful to load or unload any truck, trailer, or combination between 8:00 p.m. and 7:00 a.m. where the commercial establishment involved is located within 500 feet of any dwelling. Subsection B separately bars leaving a truck stopped with its engine idling or its refrigeration motor running during those same hours, whether on the commercial establishment's own premises within 500 feet of a dwelling or on a residential street adjacent to that establishment, directly targeting refrigerated delivery trucks left running outside grocery stores and restaurants near homes overnight.

Subsection C reaches construction sites specifically, making it unlawful to deliver materials, supplies, equipment or other related items to a construction site between 8:00 p.m. and 7:00 a.m., regardless of proximity to a dwelling. None of the three subsections states its own penalty, so a violation is governed by the Chapter 278 catch-all, § 278-52, General penalty: a fine of not more than $500, imprisonment for not more than 90 days, or both, in the court's discretion, unless a section explicitly provides otherwise. The section works alongside § 278-37, Disturbances of the peace, construction activity, which separately restricts general construction noise to 7:00 a.m. to 8:00 p.m.

Monday through Saturday and 10:00 a.m. to 6:00 p.m. Sunday, so a delivery to a job site is barred by § 278-36(C) even during hours § 278-37 might otherwise allow other construction noise.
