Wylie's noise article addresses delivery and loading noise as a distinct prohibited act separate from the construction-hours rule in Sec. 42-22(5). Subsection (7) bars any loud and excessive noise created in connection with the loading or unloading of a vehicle, or the opening or destruction of bales, boxes, crates or containers, language that reaches grocery and retail deliveries, freight trucks unloading pallets, and commercial trash and recycling pickups anywhere in the city, not only at active construction sites. Unlike subsection (5), which ties construction and construction-related deliveries to a 7:00 a.m. to 9:00 p.m. window, subsection (7) carries no separate time restriction of its own; it prohibits the loud or excessive noise outright whenever it occurs, judged against the same standard the rest of Sec.

42-22 uses, whether the noise disturbs persons of ordinary sensibilities nearby. Businesses along the State Highway 78 corridor and near Ballard Avenue that receive early-morning deliveries or use forklifts and pallet jacks to break down crates need to keep that noise from carrying into neighboring dwellings or hotels. Sec. 42-23 sets the penalty for any Article II violation, including subsection (7), at the Sec. 1-13 general penalty, a fine of up to $500.00 per offense, with each day of a continuing violation a separate offense.

Sec. 42-23 also preserves a property owner's or occupant's civil remedies, and Sec. 42-24 lets the city seek an injunction against a business with recurring loading-noise complaints.
