Section 509.10 opens with a general ban: the creation of any loud, disturbing and unnecessary noise in the City is prohibited. Subsection (b) then lists eleven specific acts the City Council has pre-declared to meet that standard, and paragraph (5) puts delivery and freight noise squarely on the list: the creation of a loud and excessive noise in connection with loading or unloading any vehicle is a violation regardless of the time of day or the zoning district where it happens. Because the enumeration is expressly non-exclusive, the same conduct can also be charged directly under the general prohibition in subsection (a) if a court finds the specific paragraph does not fit the facts.

Unlike the garage and bar/night-club paragraphs in the same subsection, paragraph (5) carries no fixed curfew hours or distance-to-housing test, so a truck banging pallets or running a compressor while loading can be cited at any hour if it rises to the level of loud and excessive noise disturbing the area. The Youngstown Police Department responds to complaints from residents and businesses near loading docks, warehouses and downtown delivery zones along Federal Street, and an officer's observation of the noise, rather than a decibel meter reading, supports the citation.

The rule reaches any vehicle, not only commercial trucks, so a resident's own loading and unloading activity late at night can also trigger a citation under this paragraph.
