Chicago classifies generators as mechanical stationary sources under Section 8-32-090. Between 8 PM and 8 AM, generator noise cannot exceed 55 dB(A) at 100 feet or 70 dB(A) at 10 feet from the source. Construction generators must also comply with Section 8-32-070 construction noise limits.
Generators in Chicago fall under the mechanical stationary source regulations of Section 8-32-090 of the Noise and Vibration Control ordinance. Between 8 PM and 8 AM, generator noise cannot exceed 55 dB(A) measured at 100 feet from the source, or 70 dB(A) measured at 10 feet. Daytime limits are somewhat more permissive. Construction generators used on job sites are additionally regulated under Section 8-32-070, which limits construction noise during permitted hours. Portable generators for residential use during power outages are generally tolerated for the duration of the emergency, but chronic or non-emergency use of generators that exceeds noise limits is subject to enforcement. Permanent standby generators require building permits and must meet both the noise ordinance and zoning setback requirements. The Department of Public Health enforces generator noise standards and may require sound-attenuating enclosures for generators near residential property lines. Film production generators are regulated under separate permit conditions.
Generator noise violations under Section 8-32-090 may result in fines from the Department of Public Health. Generators operating without required permits face additional building code violations. Continued non-compliance leads to escalating fines.
