New Brunswick, NJ Noise from Specific Sources: Generator Noise (2026)

Section 17.03.280, Generators, was adopted by Ordinance O-112205 on 12-21-22. Its single operative sentence reads that, except within the I-1 and I-2 industrial zones, the installation and usage of permanent diesel or gasoline powered generators shall be prohibited. That makes the City of New Brunswick a place where a permanent diesel or gasoline standby generator is barred in every residential, commercial, office, institutional and conservation zone. The exception names the I-1 and I-2 zones and the section prints no other zone. The text speaks only to permanent diesel or gasoline powered units; it does not mention portable units, natural gas units or battery systems.

A generator that is allowed, in I-1 or I-2, still meets the outdoor mechanical equipment standards of Section 17.03.225, which lists auxiliary power generators by name. Subsection A requires the equipment to be muffled so as to comply with the Noise Control Act of 1971 (N.J.S.A. 13:1G-1 et seq.) and the New Jersey Noise Control Regulations (N.J.A.C. 7:29). Subsection B sets a minimum setback of ten (10) feet from any property line abutting a residential zone or residential use, or five feet from any nonresidential property line. Subsection C requires screening by evergreen plantings, placement completely behind the building envelope, or fencing or other enclosures designed for the purpose.

The noise chapter adds its own ceiling. Section 8.28.040 sets maximum permissible sound levels in dBA for stationary sources, measured at or within the real property line of the receiving property, and Section 8.28.050 A bars any noise disturbance. The construction fee schedule in Section 15.04.120 lists Emergency generator systems at $150.00 and prices electrical permits for Transformers, generators by rating, from $50.00 for 0 to 25 kW/KVA up to $450.00 over 500 kW/KVA.
