The City of Maricopa does not regulate aircraft noise. MCC 9.20.010 expressly exempts aircraft operated in conformity with federal law, FAA air regulations or air traffic control instructions. Aircraft noise is governed by the FAA, not the city, consistent with federal preemption of aviation operations.
Aircraft noise is outside the City of Maricopa's enforcement authority. The general public-peace ordinance MCC 9.20.010 lists, among its exemptions, 'any aircraft operated in conformity with, or pursuant to, federal law, federal air regulations or air traffic control instructions issued pursuant to or within duly adopted federal air regulations,' together with noise from aircraft operated under a declaration of emergency under federal air regulations. The zoning performance standard MCC 18.110.050 also acknowledges that airplanes are a normal example of community noise. This treatment reflects federal preemption: the Federal Aviation Administration and federal law control aircraft operations and aviation noise, leaving little room for municipal regulation of overflights or airport noise. Maricopa is served by the Phoenix metropolitan air corridors and is near regional aviation facilities, but complaints about aircraft noise are directed to the FAA or the operating airport rather than to City Code Enforcement. The city's noise ordinances instead focus on ground-based sources such as construction, vehicles, animals, amplified sound, and stationary equipment.
Because aircraft operated under federal regulations are exempt under MCC 9.20.010, the city does not issue citations for aircraft noise. Concerns about overflights, flight paths or airport operations should be raised with the FAA or the relevant airport authority.
