The City of Maricopa prohibits amplified sound that disturbs the peace. MCC 9.20.010 makes it a public nuisance for businesses to play music so loudly as to disturb others without city permission, and MCC 18.110.050 restricts amplifiers, stereos and instruments that are plainly audible beyond the property line, especially after 10:00 p.m.
Amplified music is regulated by both Maricopa noise ordinances. MCC 9.20.010 declares it a public nuisance for any restaurant, hotel, dance hall, show, store or place of public amusement to play, or permit to be played, any music or musical instrument (live, radio, phonograph or other mechanical means) 'in such a loud or unusual manner as to be offensive to the senses' or to disturb the slumber, peace and quiet of others, unless written permission is first obtained from the city manager or city council. The zoning performance standard, MCC 18.110.050(B)(2), separately prohibits 'using, operating, or permitting to be played any electronic music device, television, amplifier, musical instrument, or instrument, machine or device used for the production, reproduction or emission of sound' when the noise is excessive or annoying, lasts at least 15 minutes or occurs after 10:00 p.m. but before 6:00 a.m., is plainly audible beyond the property line, and disturbs the neighborhood. Where music contains a steady tone, is repetitive, or conveys speech, the maximum allowable noise level under MCC 18.110.050 is reduced by five decibels. Temporary use permits are available for approved special events, parades, concerts and festivals.
Playing amplified music in violation of these rules can lead to Code Enforcement citations. Businesses that amplify music without required city permission violate MCC 9.20.010. Under MCC 18.110.050, after three violations on the same property the property owner may also be held responsible.
