In the City of Maricopa, construction, demolition, landscaping and similar work is generally allowed 5:00 a.m. to 8:00 p.m. Monday through Friday under the zoning performance standard. The public-peace ordinance separately prohibits outside construction within 1,000 feet of a completed home between 8:00 p.m. and 5:00 a.m., with reduced 7:00 a.m. to 7:00 p.m. weekend/holiday hours.
Maricopa's two noise ordinances set construction windows that differ slightly. MCC 18.110.050 exempts construction, repair, remodeling, demolition, drilling, landscape maintenance, lawn/yard work and excavation from its noise rules when conducted 5:00 a.m. through 8:00 p.m. Mondays through Fridays; at a person's own residence such work is allowed 6:00 a.m. to 8:00 p.m. on Saturdays and Sundays. The general public-peace ordinance, MCC 9.20.010, is stricter for work near homes: it is unlawful to operate construction equipment (pile drivers, power shovels, pneumatic hammers, derricks, hoists, etc.) or perform outside construction or repair work within 1,000 feet of a completed residential structure between 8:00 p.m. and 5:00 a.m. This prohibition extends to set-up work and construction travel passing within 1,000 feet of a home. On Saturdays, Sundays and city-recognized holidays, such work may not begin before 7:00 a.m. and must stop by 7:00 p.m. Contractors needing different hours can apply for a written permit from the city, which the city manager may grant after weighing noise, traffic, and neighborhood impact.
Working outside the permitted hours near homes violates MCC 9.20.010 and can draw Code Enforcement citations under the public-peace title. The city may require a written noise permit (kept on site and shown on request) for work at off-hours or higher noise levels; conducting off-hour work without that permit is a violation.
