Sutter County Zoning Code Sec. 1500-21.5-070(H) exempts from the county noise standards any activity to the extent its regulation has been preempted by state or federal law. Aircraft in flight are regulated exclusively by the FAA, so the county's dBA limits do not apply to overflights or operations at the county-owned Sutter County Airport, a general aviation field south of Yuba City. At the state level, the California State Aeronautics Act (Public Utilities Code Sec. 21669 et seq.) directs the Department of Transportation to adopt noise standards for airports, implemented in the California Airport Noise Standards (21 Cal. Code Regs. Sec. 5000 et seq.), which set 65 dB CNEL as the acceptable community noise exposure level around airports. County Ordinance Code Chapter 1200 (Airport Rules) regulates airport ground operations such as ultralight aircraft, parking and speed limits, but contains no dBA noise limits.
The County does not enforce noise limits against aircraft operations. Airport noise concerns are addressed through the FAA and, for airport proprietors, the California Airport Noise Standards administered by the Caltrans Division of Aeronautics; violations of county airport ground rules are addressed under Ordinance Code Secs. 1200-020 and 1200-090.
