Amplified music in Leander is governed by Section 8.04.002(c) of the Code of Ordinances. Using, operating, or permitting any sound-production or reproduction device, radio, receiving set, musical instrument, drums, phonograph, television, loudspeaker, or sound amplifier in a manner that causes a noise disturbance is prohibited. The ordinance establishes that such activity is a 'noise disturbance per se' if conducted between 10:00 p.m. and 7:00 a.m. Sunday through Thursday, and between 11:30 p.m. and 7:00 a.m. Friday and Saturday. Subsection (c)(b) separately addresses stationary loudspeakers and amplifiers: using one, particularly between 10:00 p.m. and 7:00 a.m., to produce sound of such intensity that it annoys or disturbs persons of ordinary sensibilities in the immediate vicinity is prohibited. The ordinance carves out a narrow exception allowing the infrequent, short-duration use of a loudspeaker or amplifier by a religious organization to play music, provided the intensity does not annoy or disturb such persons. At all times, amplified sound must also stay within the property-line decibel caps for the zone (for example, 65 dBA day / 55 dBA night in residential districts). Higher 85 dBA allowances exist only for council-adopted entertainment zones, school district events, and approved special-event permits.
Amplified music that crosses the property line during the per-se windows, that exceeds the zone dBA cap, or that disturbs neighbors via a stationary loudspeaker is a violation. Citations issue to the responsible party and are penalized under the general penalty (Section 1.01.009).
