The city engineer may grant administrative exemptions for emergency work, for concrete placements on city projects, and for work in city rights-of-way or easements during the 9 p.m. to 7 a.m. window when delay would adversely affect public safety, or for concrete pours when the pour will take longer than four hours, the heat index is forecast above 100 degrees by noon, or the work is in a public right-of-way or easement. City Council may also approve overnight concrete placements near homes only if strict conditions are met, including that the project is within 600 feet of an occupied residence, the pour exceeds four hours, the heat index will exceed 100 degrees, the work stays within zone noise limits, the overnight pour lasts no more than three consecutive days, and 48-hour door-hanger notice is given to homes within 600 feet.
Running construction or demolition equipment that causes a noise disturbance between 9 p.m. and 7 a.m. without a granted exemption is a prima facie violation, as is exceeding the applicable zone dBA cap at any hour. Penalties are assessed under the Code's general penalty (Section 1.01.009).
