Operating, playing or permitting the operation or playing of any radio, television, phonograph, drum, musical instrument, sound amplifier or similar device which produces, reproduces, or amplifies sound:a.Between the hours of 10:00 p.m. and 7:00 a.m. the following day in such a manner as to create a noise disturbance across a real property boundary or within a noise sensitive zone (except for activities open to the public and for which a permit has been issued by the City).b.In such a manner as to create a noise disturbance at fifty (50) feet (fifteen (15) meters) from such device, when operated in or on a motor vehicle on a public right-of-way or public space, or in a boat on water.

The Chief of Police's Noise Control Officer enforces the article and can issue special variances for time-limited amplified activities under Sec. 17-255; appeals of an NCO or Chief of Police decision go to the Public Safety Advisory Board and then, if desired, to the City Council, whose decision is final.

Sec. 17-259(B) makes any violation of the noise article punishable in accordance with the Code's general penalty, Sec. 1-13(A): a fine up to $500, imprisonment up to 90 days, or both, with each day of a continuing violation charged as a separate offense. The City may also seek an injunction abating a violating device as a public nuisance, and the Chief of Police can order an immediate halt to sound exceeding the health-and-safety thresholds in Sec. 17-258, with the City Attorney required to seek a court injunction within 10 days to keep that order in force.
