RMC 5-1-18 expressly identifies amplified music sources including radios, phonographs, disc players, tape decks, stereos, televisions, and other mechanical, electrical, or electronic sound amplification devices or instruments. Any amplified sound that annoys, disturbs, injures, or endangers the comfort, repose, quiet, health, peace, or safety of other persons is declared a public nuisance. The 25-foot audibility test (subsection A) and 5-dB-over-ambient threshold at the property line (subsection E) serve as prima facie evidence of violation. For apartments, condos, and shared-wall construction, the 5-dB standard is measured within the adjoining occupied unit. Importantly, subsection F(4) exempts the conduct of previously authorized and otherwise lawful public activities including entertainment, sports, music, and recreation events. This means events with proper city permits for amplified sound are not subject to the ordinance. Reedley hosts several community events throughout the year, including the Reedley Fiesta and the Festival of the Arts, where amplified music is authorized. Private parties and gatherings without permits remain subject to the full noise ordinance. Chapter 8 (Loud or Unruly Assemblage Expense Recovery) may also apply to gatherings that generate excessive amplified noise requiring police response.
