Section 44.05 defines 'noise disturbance' through a list of specific sounds, and item 4, Construction Noise, covers the sound made by privately owned and operated tools or equipment in the erection, demolition, excavation, drilling, or other such construction work. That sound becomes an unlawful noise disturbance, banned under the general prohibition in § 44.04, when it is received between 9:00 p.m. and 7:00 a.m. on weeknights, a tighter window than most of the chapter's other items, and between 6:00 p.m. and 9:00 a.m. on Saturday and Sunday, giving weekend residents two extra hours of quiet in the evening and three extra hours in the morning compared to the weeknight schedule.

The rule reaches privately owned tools and equipment used in erection, demolition, excavation or drilling work, so it covers builders, contractors and homeowners working on a jobsite alike; the section does not carve out an exception for City-permitted construction projects, meaning a contractor with an otherwise valid building permit still cannot run equipment during the barred hours. Chapter 44 has its own penalty clause at § 44.10: unless another provision sets its own fine, a violation is a simple misdemeanor punishable by a fine of not more than $500, or it can instead be charged as a municipal infraction with a civil penalty, at the discretion of a police officer, code enforcement officer or the Police Chief's designee.
