Boone County, IN Noise Ordinances: Construction Hours (2026)

Boone County Code § 92.03(B)(1), part of the county's noise ordinance (Ord. 2007-14, passed 7-16-2007), makes it unlawful to erect, demolish, alter or repair any building or structure, or to excavate for one, at any time other than between 7:00 a.m. and 7:00 p.m., Monday through Sunday, in unincorporated Boone County. The rule sits inside the chapter's general ban on noise that is unreasonably loud, injurious to health, indecent, offensive or an obstruction to the free use of property (§ 92.03(A)). The only carve-out is for an emergency or urgent necessity affecting public health and safety, and even then a contractor needs a permit from the County Building Inspector before working outside the window; that permit runs no more than three days and can be renewed for one additional three-day period while the emergency continues (§ 92.03(B)(1)).

The Boone County Sheriff or an authorized representative enforces the chapter and may enter private property on probable cause that a violation is occurring, though entry into a structure requires permission or a warrant from the county court (§ 92.06). Before any ticket is written, § 92.99 requires the officer to give a verbal warning first; only a subsequent or continuing violation after that warning can be cited. A conviction carries a fine set by the court up to $250 per violation, reduced to $100 if paid at least seven days before the scheduled hearing. The exemptions in § 92.05, covering authorized events, agricultural noise and aircraft/airport/train noise, do not extend to ordinary construction work.
