Construction in unincorporated San Diego County is limited to 7 AMβ7 PM Monday through Saturday. Construction on Sundays and legal holidays is prohibited unless a special permit is granted. Section 36.408 of the County Code regulates construction noise.
County Code Section 36.408 makes it unlawful to erect, construct, demolish, excavate, alter, or repair any building or structure in a manner creating disturbing, excessive, or offensive noise between 7 PM and 7 AM, or at any time on Sundays or legal holidays, without a permit from the County. Construction equipment must also comply with the general 75 dBA Leq 8-hour average limit when measured at the nearest property line of noise-sensitive land uses. The Department of Planning & Development Services may grant permits for after-hours work when necessary.
Violations are misdemeanors under County Code Section 36.414. Construction outside permitted hours may result in stop-work orders, fines up to $1,000, and/or up to six months imprisonment.
