Full Breakdown
Section 14-8(3)(b) of the Leominster Code of Ordinances covers every noise-generating construction and demolition activity: powered construction equipment, building erection, demolition, alteration, repair, excavation, hoisting, grading, tree and brush removal, dredging, pneumatic hammering, and even delivery of construction equipment or supplies to a job site. on Sundays. The only carve-out is for a public service or municipal utility department, or for emergency work performed with the express written permission of the Building Inspector or the Director of Public Works; emergency work defined as clearly essential to responding to a sudden and unexpected threat to public health or safety.
That written permission is capped at one week and must be renewed weekly at the granting authority's discretion. Any city-funded construction contract must reference this section in its bid invitation and carry a clause making adherence to the specified hours a material breach of contract. c. 40, section 21D rather than criminal court.
Violations & Fines
First offense: $100. Second offense: $200. Third and any subsequent offense: $300, with each day of noncompliance treated as a separate violation. A contractor on a city-funded project who breaches the construction-hours clause commits a material breach of that contract.
