Full Breakdown
' Subsection (10) also exempts city, county or state street excavation and repair work done at night when public welfare and convenience make daytime work impossible. Because section 70-4 was rewritten by Ordinance No. 287 in 2009, these construction-hour limits are current text, not a relic of the code's original 2004 publication.
Violations & Fines
Running construction or infrastructure equipment that produces loud or unusual noise outside the 7:00 a.m. to 7:00 p.m. window, without a special-consideration permit from the chief of police or public works director, violates section 70-4(b)(7) or (8). The chapter's penalty provision, section 70-5, sets a forfeiture plus costs of prosecution for the violation.
