Subsections (B)-(D) require properly maintained muffler systems, acoustical shielding when equipment is placed adjacent to developed areas, and shutdown of construction and grading equipment when not actively in use. Subsection (E) exempts public-agency work needed to avoid disrupting a public project. Subsection (F) authorizes the Police and Code Enforcement Officer to issue an immediate stop-work order on posting of notice.
A violation of NMC 8.08.025 is enforceable through the general code-enforcement provisions and may trigger an immediate stop-work order under 8.08.025(F). After service of the stop-work order, no further work is permitted except actions reasonably necessary to make the site safe or secure. Repeat violations can lead to permit revocation under NMC 8.08.050.
