Springfield, OR Noise Ordinances: Construction Hours (2026)

Springfield Municipal Code § 5.220(3)(d) treats construction activity itself as a per se noise violation outside the hours of 7:00 a.m. and 6:00 p.m., without regard to how loud the work actually is: excavating, demolishing, altering, or erecting any building after 6:00 p.m. or before 7:00 a.m. is enough to violate the section on its own. The rule sits alongside the city's other time-restricted per se violations in section 5.220(3), including the 6:00 p.m. to 7:00 a.m. curfew on compressed-air and steam-powered equipment in subsection (c), so a contractor running both power tools and construction work overnight can be cited under either or both provisions.

Subsection (4)(c) exempts work necessary to restore property to a safe condition after a natural or other disaster, or to protect persons or property from imminent danger, so emergency repairs, storm cleanup, and safety-critical stabilization work are not per se violations even overnight. The Springfield Police Department enforces the curfew, and subsection (5) sets the penalty at a fine not exceeding $720.00 under SMC section 1.205, the same violation-level penalty that applies to the rest of section 5.220's per se noise violations. A contractor who needs to work past 6:00 p.m. for a reason short of an emergency, such as finishing a pour or meeting a deadline, has no path around the curfew in section 5.220 itself; the special noise permit process in subsection (4)(b) is administered by the city manager or designee and is available for non-emergency situations if filed at least 30 days ahead.
