CMC 9.22.080 sets residential exterior limits at 55 dBA day and 50 dBA night (15-min Leq). Interior limits are 45/40 dBA. Impulsive noise may exceed the standard by up to 20 dBA.
CMC 9.22.080 Table 3-1 sets maximum exterior noise by zone: Zone I (residential) 55/50 dBA, Zone II (commercial) 65/60 dBA, Zone III (mixed-use residential) 60/50 dBA, Zone IV (industrial) 70/70 dBA. Table 3-2 sets interior standards: residential at 45/40 dBA, office at 50 dBA daytime only, and mixed-use residential at 45/40 dBA. A violation occurs when noise exceeds the zone standard for any 15-minute period, or when impulsive noise exceeds the standard plus 20 dBA at any time (measured A-weighted slow response). Impulsive noise repeating four or more times per hour between 10 PM and 7 AM is measured as continuous sound. Sound is measured at the property line, no closer than three feet from any wall and at least three feet above ground. A minimum of two 10-minute readings with 10-minute intervals are taken and averaged. If the ambient level exceeds the standard, the ambient becomes the applicable threshold. Section 5.27.605 confirms that violating the decibel standards is also a violation of the nuisance chapter.
