In other words, properly zoned industrial operations may run overnight, but a manufacturing process generating plainly audible noise in a non-industrial zone is restricted during those early-morning hours. The construction exceptions in 5-4-11(D)(4) reinforce this: construction noise is permitted at any hour in areas zoned for industrial or manufacturing uses. 'Plainly audible' is the 50-foot standard from 5-4-11(B). The defenses in 5-4-11(D) also cover emergency work and public works activities, such as repairs or construction needed for public health or traffic flow. Violations are infractions under 5-4-11(F), punishable by a fine set by Council resolution, with misdemeanor escalation after two prior violations within one calendar year. The code does not impose a numeric decibel cap on industrial sources.
