Burlington, NC Noise Ordinances: Leaf Blower Rules (2026)

City Code § 22-70(a) restricts a set of noise-producing activities in any residentially zoned area of Burlington, North Carolina, and within three hundred feet of any residentially occupied structure regardless of the surrounding zoning district. Subsection (a)(4) specifically bars 'the operation of lawn mowers and other domestic tools out-of-doors' between 10:00 p.m. and 6:30 a.m., a category that covers gas- and battery-powered leaf blowers, string trimmers, hedge clippers and similar yard equipment used outside those hours. A backstop rule in subsection (b) also treats any other mechanical noise as a violation if it is unreasonably loud under the article's reasonable-person standard or measures more than seventy decibels at the nearest complaining neighbor's property line, so daytime use is not unlimited if it is excessive.

The hours ban does not apply to emergency work protecting public health and safety or to state and city crews and contractors working in a right-of-way or utility easement. Enforcement follows article V's uniform schedule: a first violation of section 22-70 is a $150 civil penalty, a second within twelve months is $250, and a third within that period is $500, with a $25 late fee added once ten days pass unpaid. A fourth violation within twelve months, or refusal to give an officer your name, becomes a Class 3 misdemeanor carrying up to a $100 fine or thirty days in jail under G.S. §§ 14-4 and 160A-175. A cited homeowner may ask the city manager's designee for a nonjudicial administrative hearing to appeal the civil penalty.
