Fort Smith has not adopted a leaf-blower-specific ordinance and does not restrict gas-powered yard equipment by model, fuel type, or season. Leaf blowers, mowers, edgers, and chainsaws are regulated only through the general noise nuisance language in Chapter 16 of the Municipal Code and the Arkansas disorderly-conduct statute (A.C.A. Β§ 5-71-207).
Unlike a growing number of larger U.S. cities, Fort Smith has not enacted a stand-alone leaf-blower ordinance - there is no gas-blower ban, no Sunday or holiday restriction, and no codified maximum decibel rating at the operator or at neighboring property lines. Day-to-day enforcement therefore relies on three layers. First, the Chapter 16 Nuisances framework lets the Neighborhood Services Division issue a written abatement order if a particular piece of equipment is operated in a manner that becomes a continuing nuisance to a neighborhood (for example, an industrial backpack blower run for hours every weekend at dawn). Second, the Fort Smith Police Department can cite an operator under A.C.A. Β§ 5-71-207 for 'unreasonable or excessive noise' - a Class C misdemeanor - when the activity is plainly unreasonable for the time and place. Third, equipment that has been altered to bypass factory mufflers (modified two-stroke engines, removed exhaust components) violates the state vehicle-equipment statutes (A.C.A. Β§ 27-37-601 prohibits noise-producing devices on motor vehicles) and can be cited even where the underlying activity (yard work) would otherwise be permitted. Consumer two-stroke backpack blowers typically measure 70-80 dBA at 50 feet, which would routinely exceed objective limits in cities that have adopted them; Fort Smith has not.
Chapter 16 nuisance violations are processed through the Neighborhood Services abatement track (written order, 7-day window, then criminal charge). Disorderly conduct under A.C.A. Β§ 5-71-207 is a Class C misdemeanor - up to 30 days in jail and $500. Modified or factory-noncompliant equipment with stripped mufflers can be cited under A.C.A. Β§ 27-37-601 if the device is mounted on a motor vehicle.
