Summary

Yakima County exempts sounds created by lawn and garden equipment from its noise chapter from 6:00 a.m. to 10:00 p.m. under § 6.28.040(17). The code never names leaf blowers and draws no gas versus electric line. Outside that window the item (17) exemption stops, and the tests in § 6.28.030 are what remain unless another exemption fits.

These county ordinances apply to unincorporated areas of Yakima County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(1) It is unlawful for any person to make, continue, or cause to be made or continued or any person in possession of property to make, continue, or cause to be made or continued or allow to originate from the property any sound which: (a) Is plainly audible within any dwelling unit which is not the source of the sound or is generated within two hundred feet of any dwelling unit; (b) Either annoys, disturbs, injures or endangers the comfort, repose, health, peace or safety of others. (2) Sound which is "plainly audible" is sound that can be understood or identified. ... The following sounds are exempt from the provisions of this chapter: ... (17) Sounds created by lawn and garden equipment from 6:00 a.m. to 10:00 p.m.; and ... Any person who violates the provisions of this chapter shall, upon a finding of having committed the civil infraction thereof, be punished by a civil penalty not to exceed five hundred dollars.

Full Breakdown

Yakima County has no separate leaf blower ordinance. The only local provision that speaks to yard equipment is in Chapter 6.28 (Noise Control), which applies to the unincorporated area. Section 6.28.040(17) exempts from the chapter: Sounds created by lawn and garden equipment from 6:00 a.m. to 10:00 p.m. The chapter does not define lawn and garden equipment, does not mention leaf blowers, and says nothing about gas-powered versus electric machines, decibel ratings or muffler standards.

The time limit is written into the exemption itself. Between 6:00 a.m. and 10:00 p.m. the equipment sound is outside the chapter. Outside those hours item (17) no longer applies, so the general rule in § 6.28.030 is the standard left standing. That rule makes it unlawful to make or allow to originate from property any sound which is plainly audible within a dwelling unit that is not the source of the sound, is generated within two hundred feet of a dwelling unit, or annoys, disturbs, injures or endangers the comfort, repose, health, peace or safety of others. Section 6.28.030(2) defines plainly audible as sound that can be understood or identified, so no meter reading is needed.

Other exemptions on the § 6.28.040 list carry no hours. Item (7) exempts sounds originating from commercial agriculture, which matters in orchard and vineyard country, and item (18) exempts sounds created by lawfully established commercial and industrial uses. Section 6.22.040 adds that farm operations shall not be restricted to time of day or days of the week.

Under § 6.28.050 the county sheriff and other law enforcement officers enforce the chapter. This page applies to unincorporated Yakima County only. Yakima, Sunnyside, Grandview, Selah, Toppenish, Union Gap, Wapato and Zillah are separate incorporated cities, and county ordinances do not govern trust land within the Yakama Nation Reservation.

Violations & Fines

A violation of Chapter 6.28 is a civil infraction, and § 6.28.060 punishes it by a civil penalty not to exceed five hundred dollars. Running lawn and garden equipment before 6:00 a.m. or after 10:00 p.m. loses the item (17) exemption, and the sound then answers to § 6.28.030 if it is plainly audible in a neighbor's dwelling unit or annoys or disturbs others.

Frequently Asked Questions

Are leaf blowers banned in unincorporated Yakima County?
No. The county code has no leaf blower ban and does not name leaf blowers. Section 6.28.040(17) exempts sounds created by lawn and garden equipment from the noise chapter from 6:00 a.m. to 10:00 p.m., and the chapter draws no distinction between gas and electric machines.
What happens if I run yard equipment at night?
The item (17) exemption covers only 6:00 a.m. to 10:00 p.m. Outside it, § 6.28.030 makes a sound unlawful if it is plainly audible in a dwelling unit that is not the source of the sound, or if it annoys, disturbs, injures or endangers the comfort, repose, health, peace or safety of others.
What does plainly audible mean in the Yakima County code?
Section 6.28.030(2) states that sound which is plainly audible is sound that can be understood or identified. No decibel meter is written into the chapter, so a deputy relies on what can be heard and identified inside the neighbor's dwelling unit or within two hundred feet of one.
How much is the penalty?
Section 6.28.060 says a person who commits the civil infraction is punished by a civil penalty not to exceed five hundred dollars. The county sheriff and other law enforcement officers enforce the chapter under § 6.28.050.
Does this apply on the Yakama Reservation or in the city of Yakima?
No. This code covers the unincorporated area only. The cities of Yakima, Sunnyside, Selah and the other incorporated cities are separate jurisdictions, and county ordinances do not govern trust land inside the Yakama Nation Reservation, which has its own code.
