Quiet hours in Imperial County, CA โ also called the noise ordinance, nighttime noise rules, or residential quiet time โ define the hours during which excessive noise is prohibited.
Unincorporated Imperial County sets nighttime quiet hours of 10 p.m. to 7 a.m. under Title 9, Division 7. During these hours the allowable one-hour average sound level drops, and amplified devices plainly audible at 50 feet become prima facie violations.
Imperial County's noise rules for unincorporated areas live in Title 9 (Land Use Ordinance), Division 7, Noise Abatement and Control. Section 90702.00 sets one-hour average sound level limits that change with the time of day. In R-1 residential zones the daytime limit (7 a.m. to 10 p.m.) is 50 decibels, dropping to 45 decibels at night (10 p.m. to 7 a.m.). R-2, R-3, R-4 and other residential zones are allowed 55 decibels by day and 50 decibels at night. Limits are measured at or beyond the property line of the parcel producing the noise. Separately, Section 90703.02 treats the operation of any radio, sound amplifier, musical instrument or similar device between 10 p.m. and 7 a.m., in a manner plainly audible at 50 feet from the building, structure or vehicle, as prima facie evidence of a violation. The County's general nuisance prohibition (Section 90703.00) applies around the clock to any disturbing, excessive or offensive noise that annoys a reasonable person of normal sensitivity. The nighttime window mirrors the standard 10 p.m.-7 a.m. quiet period used across California counties. There is no separate weekend or holiday schedule in the ordinance.
Enforced by Planning & Development Services Code Enforcement and the Sheriff. Under Title 9, Division 13, a first violation is an infraction punishable by a fine up to $1,000, a second up to $1,250, and a third (or repeat) violation is a misdemeanor punishable by up to $1,500 and/or six months in jail; each day is a separate offense.
