Morgan County, IN Noise Ordinances: Quiet Hours (2026)

Morgan County Code § 94.01 bars generating any unreasonably loud, disturbing or unnecessary noise in the unincorporated county that interferes with comfortable enjoyment of life or property, or disturbs the comfort, repose, health, safety, peace or welfare of a person or livestock, at any time of day. Section 94.05(B) layers a specific nighttime curfew onto vehicle noise: no motor vehicle, motorcycle, ATV, dirt bike, go-cart or recreational vehicle may produce unreasonably loud, disturbing or unnecessary noise between 9:00 p.m. and 7:00 a.m. where five or more residences sit within 750 feet of the tract where the vehicle is operated.

Section 94.04 lists factors an officer weighs when judging a noise complaint under either provision: time of day, proximity to residential structures, whether the noise is recurrent or constant, its volume and intensity, whether it is electronically amplified, the zoning character of the area, whether it stems from a lawful business, and whether the source could reasonably mitigate it. Section 94.06 gives the County Sheriff and deputies full authority to issue citations, and lets the County Prosecutor or County Attorney pursue injunctions in addition to citations. The Board of Commissioners adopted the current excessive-noise subchapter by Ord. 2009-04 (2009), amending the original Ord. 3-1-1.1 (2003).
