Morgan County, IN Parking Rules: Driveway Rules (2026)

Anyone building or improving a driveway, entrance or approach that connects to a county street, road, highway or right-of-way in unincorporated Morgan County, Indiana needs a permit from the Morgan County Highway Department before starting work, under § 96.15 and § 96.16(A). The written application must identify the parcel and the owner's name, address and phone number (§ 96.16(B)). Because a driveway permit is a prerequisite, § 96.16(C) bars the county from issuing an improvement location permit or building permit for the site until the driveway permit is obtained, unless no driveway work is actually needed.

Construction standards differ by use: a single-access private driveway must follow the Morgan County Subdivision Control Ordinance adopted February 11, 2003 (§ 96.17(A)), while multi-use, commercial and industrial driveways, subdivision entrances and new roadways must meet the Indiana Department of Transportation Driveway Permit Handbook, which can require deceleration lanes, turn lanes or passing blisters (§ 96.17(B)). A 'low volume multiple use driveway,' serving no more than five single-family or two double-family residences, follows the private-driveway standard (§ 96.17(D)). Every completed driveway needs a culvert pipe sized by the Highway Department to carry surface water, and the Department inspects the finished culvert and driveway before a certificate of occupancy issues (§ 96.17(E), (F)).

Permit fees under § 96.18 run $50 per residential access point, $150 for a subdivision or multi-residence access, and $150 for each commercial or industrial access point.
