Gainesville, FL Noise Ordinances: Vehicle Noise (2026)

Section 15-3(d)(9) of the Gainesville Code makes it unlawful for a person operating or occupying a motor vehicle on a street or highway to play or amplify a radio, tape player, or other mechanical sound-making device, whether mounted inside the car or attached to the exterior, so that the sound is plainly audible at 25 feet or more from the vehicle. A second, separate trigger applies near sensitive uses: sound that is merely 'louder than necessary for the convenient hearing by persons inside the vehicle' in areas adjoining churches, schools, or hospitals is also a violation, even if it does not carry the full 25 feet.

'Plainly audible' for this subsection means a sound a person with normal hearing faculties can clearly identify from outside the vehicle; officers assess it under Section 15-5(b) by getting a direct line of sight and hearing to the vehicle. Law enforcement and emergency vehicles equipped with communication devices needed for their duties are exempt. Unlike most other noise violations in Chapter 15, which start with a warning and give a 'reasonable time' to comply, Section 15-6(a)(1)d expressly waives the warning requirement for subsection (d)(9): officers can write a citation on first contact.

Violations are also enforceable as public nuisances under Section 15-6(e), letting the city seek a restraining order or injunction. Penalties follow the general penalty in Section 1-9: a fine of up to $500, up to 60 days in jail, or both, with each day of continuing violation treated as a separate offense.
