Eden Prairie, MN Outdoor Cooking: BBQ & Propane Rules (2026)

Eden Prairie rewrote MSFC Appendix O's balcony and patio fire rule entirely through Section 9.05.H, adopted by Ordinance No. 10-2025 on June 26, 2025. Appendix O 1.1 now prohibits kindling, maintaining or causing 'any fire or open flame,' language broad enough to cover charcoal grills, propane barbeques and other open-flame cooking devices, on any balcony above ground level in a qualifying building. The rule only reaches buildings with three or more dwelling units where at least two of those units are stacked vertically, so a single-family home, duplex, or a three-unit building with all units side by side on one level falls outside this specific ban.

The same prohibition extends to a ground-floor patio, but only within 15 feet of the structure, closing off the option of simply moving a grill down to ground level right next to the building. Enforcement runs through the City's adopted Minnesota State Fire Code under Section 9.05, Subd. 1 and 2, with the Fire Chief serving as Fire Code Official and the department of fire prevention responsible for inspections and citations. Because the amendment folds into the MSFC rather than standing alone, a violation is treated as a Fire Code violation subject to the code's general enforcement and permit-revocation tools in Subd. 6.
