Single-family and two-family homes can grill freely. But under the Ohio Fire Code (Sec. 308), charcoal and LP-gas grills may not be operated on combustible balconies or within 10 feet of combustible construction at multi-family buildings โ a rule that affects apartments and condos in Lorain and Elyria.
The Ohio Fire Code section 308.1.4 bars operating charcoal burners and other open-flame cooking devices on combustible balconies or within 10 feet of combustible construction, and this restriction is aimed at multi-family (three-or-more-unit) buildings. LP-gas cooking devices with a container capacity of 2.5 pounds or less (a nominal one-pound cylinder) are exempt, as are one- and two-family dwellings and buildings protected by automatic sprinklers. Ohio adopted an amendment allowing charcoal burners on combustible balconies only where the fire code official approves and an adult attends, a fire extinguisher is present, and combustible materials are cleared. Enforcement is by the local fire department, not the county.
Grilling on an apartment balcony or within 10 feet of combustible construction violates the Ohio Fire Code and can bring a fire-code citation, misdemeanor penalty, and abatement order from the local fire authority.
