Full Breakdown

Adopted under Ord. S. Chapter 168B, because the City Council found abandoned and junk vehicles harbor disease and vermin and become a blight and safety hazard. 17 makes it a straight misdemeanor to abandon, park, keep, place or store any junk vehicle or inoperable vehicle on public property, or on private property without the consent of the person in control of it. 18(A) separately bars anyone from parking, keeping, placing, storing or abandoning a junk or inoperable vehicle on a public street, alley or public property at all, and lets the City Manager, a designee, or any contracted peace officer impound it.

18(C) gives private property owners and occupants a 48-hour window: after that, allowing a junk or inoperable vehicle to sit on the property becomes a violation, unless the vehicle is in an enclosed building, is on the premises of an operating business and necessary to it, or is in an approved city storage depository. 18(G) requires the City Manager's designee to give ten days' written notice by mail, posted notice, or personal delivery, describing the vehicle and warning that it will be towed if not moved or stored within ten days. 16.

Violations & Fines

A first violation of § 90.17, abandoning or storing a junk or inoperable vehicle, is a misdemeanor under § 10.99, carrying up to 90 days in jail or a $1,000 fine. Before the city impounds a vehicle from private property it must give ten days' written notice under § 90.18(G); after that period the vehicle may be towed and the owner billed for removal and storage before it is released.

Frequently Asked Questions

How long can a junk car sit in my driveway in Brooklyn Park?
Up to 48 hours. Section 90.18(C) makes it unlawful for a property owner or occupant to allow a junk or inoperable vehicle to sit longer than that, unless it is inside an enclosed building, part of an operating business's necessary equipment, or held in an approved city storage depository.
Can the city tow my car without warning?
Not from private property. Section 90.18(G) requires ten days' written notice, by mail, posting on the property, or personal delivery, describing the vehicle and stating it will be towed and impounded if not moved or properly stored within that period.
Is leaving a junk vehicle on the street ever allowed?
No. Section 90.18(A) bars parking, keeping, placing, storing or abandoning any junk or inoperable vehicle on a public street, alley or public property outright, and lets the City Manager, a designee, or a contracted peace officer impound it immediately.
What counts as a 'junk vehicle' under the ordinance?
Section 90.16 defines a JUNK VEHICLE as one that is not in operable condition, is partially dismantled, is used for parts or repair of other vehicles, is kept for scrapping or salvage, or has no substantial potential use consistent with its normal function.
