Section 108-5.16 allows one commercial-registered vehicle at 8,000 pounds or less, with construction-site and farm exceptions.
A. No commercial motor vehicle having a rated maximum gross vehicle weight (GVW) in excess of 8,000 pounds or having more than two axles shall be parked or stored overnight on any occupied property which is primarily used for residential purposes or on any vacant property in a residentially zoned area, except for vehicles engaged in construction, parked or stored on an active construction site. Two axle tractors shall also be prohibited from storage on residentially zoned or used property. B. Not more than one motor vehicle with commercial motor vehicle registration, having a rated maximum gross vehicle weight (GVW) of 8,000 pounds or less, shall be parked or stored overnight on any occupied property which is primarily used for residential purposes or on any vacant property in a residentially zoned area, except for vehicles engaged in construction, parked or stored on an active construction site. The aforementioned regulations for commercial vehicle storage shall not apply to vehicles located on and necessary to the operation of a farm.
Full Breakdown
Section 108-5.16(A) of the Monroe Township Code says no commercial motor vehicle having a rated maximum gross vehicle weight (GVW) in excess of 8,000 pounds, or having more than two axles, can be parked or stored overnight on an occupied property primarily used for residential purposes, or on any vacant property in a residentially zoned area. The only carve-out in that subsection is for vehicles engaged in construction that are parked or stored on an active construction site. Two axle tractors are also prohibited from storage on residentially zoned or used property, so a tractor cab cannot be kept at home even though it has only two axles.
Lighter vehicles get a numeric cap rather than a ban. Under subsection (B), not more than one motor vehicle with commercial motor vehicle registration, having a rated maximum GVW of 8,000 pounds or less, can be parked or stored overnight on an occupied residential property or on a vacant property in a residentially zoned area. The same construction-site exception applies. The provision does not apply to passenger automobiles with commercial motor vehicle registration, so a car that simply carries commercial plates is outside the one-vehicle count.
Subsection (C) exempts vehicles located on and necessary to the operation of a farm from all of these commercial vehicle storage rules. The test is the vehicle's rated GVW and axle count, not its appearance or lettering, and the rule is about overnight parking or storage, so a delivery truck making a daytime stop is a different question from one kept at the house overnight. Chapter 108 is enforced by the Zoning Officer, who orders violations remedied in writing under § 108-14.1.
Violations & Fines
Violations of Chapter 108 are punished under § 108-14.4. The owner, tenant or anyone who takes part in the violation faces a fine of not more than $1,000, imprisonment for a term not exceeding 90 days, or both, and each day the violation continues counts separately. The Zoning Officer can enter premises during the daytime or normal business hours to inspect and orders the condition remedied in writing.
