Section 277-17 carves out four exceptions. A covers any vehicle having four wheels only, of less than 20 feet in length, bearing noncommercial plates. B covers a four-wheel vehicle under 20 feet with commercial plates that also bears a resident commercial vehicle sticker. The owner carries the burden of proof that the vehicle is also used for personal use, only one sticker is issued per household, and the vehicle registration must list a West New York address. Commuter vans never qualify and cannot park on public streets. The West New York Parking Services Utility charges a $100 application fee for the sticker, renewed every six months for $50.
Exception C covers vehicles owned and operated by the Town, the Board of Education or any other municipal, county, state or federal agency, or a parochial, elementary or secondary school based in the Town. Exception D covers taxicabs based and licensed in the Town while parked to conduct taxicab service.
Section 277-32 gives the Parking Services Utility discretion to exempt service and contractor vehicles that must temporarily park in Residential Permit Parking areas without permits, for a period not to exceed eight consecutive hours. Residents must call the Utility to request permission with 24 to 48 hours of anticipated notice. Section 277-34 says the Parking Services Utility and the West New York Police Department enforce the article.
Violations & Fines
Section 277-18 provides that any person who violates the article is liable, upon conviction, to a penalty of not more than $500 for each violation, and each one hour that a violation continues is a separate offense. Commercial vehicles parked in prohibited areas can be removed by towing at the owner's or operator's expense. Counterfeiting or using an altered parking permit under § 277-33 carries a penalty of no less than $250 and no more than $500, and/or up to five days in jail.
