Lincoln County, SD Parking Rules: Driveway Rules (2026)

Lincoln County Code § 92.01, ACCESS MODIFICATIONS PROHIBITED, bars anyone from constructing or modifying an access, a driveway or entrance, abutting a county road without first getting an approved access permit from the county's Highway Superintendent. Section 92.02 governs how that permit works: the Highway Superintendent may issue and approve it, but the permit is valid only for county roads under the Superintendent's authority, the application must be filed at least two weeks in advance, incomplete applications are not approved, the permit issues by email, and it expires 180 days after approval; the Superintendent can suspend, revise, or revoke it at any time.

Section 92.03 requires the permit fee to accompany the application or be paid within 48 hours of approval, with a residence access permit costing $80, a field or farm access $55, a commercial access $175, an improvement to an existing access $25, and a temporary access $25, all deposited to the County Road and Bridge Fund; unpaid fees void the permit and expired permits are not refunded. Section 92.04 bars building an entrance in a way that interferes with highway drainage under SDCL § 31-24-6.

The penalty for skipping the permit is set out in § 92.99(B): constructing an access without one, or violating a permit's specific terms, is punishable by a maximum fine of $500, on top of any other civil or criminal penalty the law allows.
