Owensboro Municipal Code Sec. 5-137(b)(23), titled Parking in Yards, makes it unlawful to park or store any vehicle on a surface not intended for use as vehicular parking, and the ordinance specifically identifies a yard, or any space where reaching the parking spot necessarily requires crossing an uncut curb or other space clearly not intended to allow such access, as violating the rule. The provision is grouped with the other twenty-four public nuisance categories in Sec. 5-137(b), meaning it is enforced the same way as junked vehicles, weeds and accumulated trash.

A code enforcement officer who observes a vehicle parked on an unpaved yard, lawn or curb-crossing area may issue a notice of violation under Sec. 5-129, allowing a reasonable time to move the vehicle or bring the surface into compliance before a citation follows. A citation must specify the address, the date of inspection, the section violated and the fine schedule, and the owner has seven days under Sec. 5-130 to pay or file a written appeal with the public works director for a hearing before the Property Maintenance Code Enforcement Board.

Because parking in yards is not listed among the structural violation categories, it falls under the property maintenance code's general Other Violations fine tier unless the board classifies it otherwise. Board decisions are appealable to Daviess County District Court under Sec. 5-135.
