Summary
St. Joseph County requires every off-street parking area and connecting driveway to be hard surfaced with asphalt, concrete, pervious pavement, pavers or an equivalent dust-free material meeting the county engineer's specifications, under Zoning Ordinance § 154.419(B). Individual single-family and two-family dwellings, and agricultural uses, are exempt from the hard-surface mandate.
(B)Surface materials. Except for agricultural uses or individual single family dwellings, all required off-street parking areas and any driveway, interior access driveway or interior access drive to and from such off-street parking areas shall be hard surfaced with asphalt, concrete, pervious pavement, pavers or other material to provide a durable, dust-free surface, which meets or exceeds the minimum specifications prescribed by the county engineer, provided, however, a temporary or seasonal use permitted by the district in which such temporary or seasonal use is located may use an unimproved or gravel surface for the duration of the temporary or seasonal use. If a temporary gravel surface is provided, such gravel shall be removed and the off-street parking area shall be returned to its prior condition immediately upon cessation of the temporary or seasonal use.

Violations & Fines
An unpaved or otherwise noncompliant parking area or driveway serving a nonexempt use is enforced as a zoning violation under § 154.999. The zoning administrator's staff issue a notice of violation with ten days to correct the surface before a citation and fine, drawn from the county's schedule of fines and fees, can be issued, and each day the surface remains noncompliant is treated as a separate violation subject to an additional fine.
