Full Breakdown
The Township Council regulates residential driveway parking in § 134-67.1, Residential districts, under the outdoor storage article of Chapter 134. Subsection A(2) says motor vehicles shall only be parked within paved driveway areas and may not be parked on any grass portion of the front, rear or side yards. Subsection A(1) covers recreational and commercial trailers: no residential driveway area within the front yard shall be utilized for the storage of boats, commercial or recreational trailers licensed or unlicensed by the NJMVC or other state agency, mobile homes and other similar recreational vehicles. Such vehicles can be parked in a side or rear yard if no closer than five feet to a side yard and 10 feet from a rear yard, and in no event in any front yard. Subsection A was added 10-15-2003 by Ord. No. 56-2003 and A(1) was amended 5-20-2020 by Ord. No. 17-2020.
The driveway itself is regulated in § 134-62.1(B). Every dwelling unit hereafter erected must have a driveway improved with asphalt (also called bituminous concrete), paving stone, brick paver, concrete or similar surface, and gravel driveways shall not be permitted. Driveway grades run from 1% minimum to 12% maximum, residential driveways must be a minimum of three feet from the side property lines, and a driveway entering a street with a right-of-way of 60 feet or more must provide turnaround space so cars can enter that street frontwards. Section 134-62.1(C) requires a minimum of two off-street accessory parking spaces for every dwelling unit.
Subsection B of § 134-67.1 limits commercial vehicles in residential zones. No more than one commercial vehicle, vehicle registered as a school bus, or limousine can be parked, stored or garaged overnight, and it cannot exceed a gross vehicle weight rating of 15,000 lbs, 84 inches in width or height, or 240 inches in length. It must be owned by and registered to the occupant or his employer and be parked on an improved surface. Construction equipment vehicles are allowed on a temporary basis while a valid, open construction permit covers work on the lot.
Violations & Fines
Neither § 134-67.1 nor § 134-62.1 prints a penalty of its own. Grass parking or a front yard trailer is charged under § 1-15.1 of the Township Code, which sets the maximum at imprisonment not exceeding 90 days, a fine not exceeding $2,000, or community service not exceeding 90 days. Section 1-15.6 requires a 30-day period to cure and a hearing opportunity before a zoning fine above $1,250.
