Full Breakdown
Section 200-16 of the Wayne Township Code does not set hours or vehicle limits for loading zones. It designates as loading zones the locations described in Schedule XIII (§ 200-41), which is attached to and made part of Chapter 200. The section was added 6-2-1976 by Ord. No. 64-1976.
Schedule XIII prints three columns: Name of Street, Side and Location. The one entry is Legion Place, west side, between the bed of old Route 23 and 50 feet easterly therefrom, added 3-2-1988 by Ord. No. 10-1988. A hours column is not part of the printed schedule. Section 200-4 still applies on top of the designation, so the stricter stopping, standing and parking provisions of N.J.S.A. 39:4-138 or any other New Jersey statute are not displaced by a loading zone.
Loading on a development site is governed separately by Chapter 134, Land Development. Section 134-72.3 requires that the number and size of all parking and loading spaces meet the zoning regulations, and subsection B sets a minimum width of 10 feet and a minimum length of 45 feet for any off-street loading space. Ingress and egress to a loading area must be paved and include turning areas for ease of mobility, ample clearance and safety of vehicles and pedestrians. A loading area serving heavy-duty vehicles needs a minimum of six inches of HMA stabilized base course and two inches of HMA surface course, drained so water does not accumulate on the site.
Subsection G requires off-street loading areas to be designed to prevent maneuvering of vehicles into or out of spaces within any portion of any street. Space stripes are four inches wide using white reflective paint, loading areas are curbed with granite block, and the maximum grade permitted is 4%. Those standards were amended 6-19-2013 by Ord. No. 22-2013.
Violations & Fines
A violation of the on-street loading zone designation in Chapter 200 is punished under § 200-3: on conviction, a fine not exceeding $75 or imprisonment not exceeding 15 days or both. The off-street loading standards in § 134-72.3 are design requirements within Chapter 134, Land Development, and the number and size of spaces must meet the zoning regulations under subsection A.
