Effective July 1, 2024, Florida Senate Bill 1084 amended Section 366.94 to preempt local regulation of electric vehicle charging stations, transferring exclusive authority to the state Department of Agriculture and Consumer Services.
Under Florida Statutes Section 366.94, as amended by SB 1084 (2024), local governments including Dunedin are prohibited from enacting or enforcing ordinances or regulations relating to electric vehicle charging stations. The Florida Department of Agriculture and Consumer Services has exclusive regulatory authority. Dunedin previously partnered with Duke Energy to install ten public charging stations and operates EV fast chargers at the Dunedin Public Library, but city-level regulation is preempted. Building permits, electrical inspections, and zoning siting requirements that apply uniformly to all electrical equipment may still apply to home or commercial installations.
Local enforcement of EV charging-specific rules is preempted. State agency rules apply to charging station compliance and standards.
