Montgomery County actively promotes EV infrastructure under Bill 40-21 requiring EV-ready parking in new construction. Residential charger installation requires a DPS electrical permit. The county offers rebates through its Green Bank program. MD law prohibits HOAs from blocking EV charger installation.
Montgomery County enacted Bill 40-21 mandating EV-ready parking spaces in new construction projects. New residential buildings with 5+ units must provide at least 20% of spaces as EV-ready (conduit and panel capacity in place). New commercial buildings must include EV charging stations in at least 10% of parking spaces. Residential homeowners may install Level 1 or Level 2 chargers with a DPS electrical permit. Maryland law (HB 830, effective 2023) prohibits HOAs from unreasonably restricting EV charger installation by homeowners. The Montgomery County Green Bank offers financing programs for EV infrastructure. WSSC requires separate metering approval for commercial charging stations that could affect water-sewer billing. The county operates a growing public charging network through the Department of Environmental Protection. Utility interconnection with Pepco may require panel upgrades for Level 2 (240V) installations.
No penalty for installing chargers. Unpermitted electrical work: DPS stop-work order plus $500 fine. HOA interference with charger installation: violates MD HB 830, enforceable through courts.
