Under EMC Section 16.05.110, trash, recycling, and organics containers must be stored out of view from the public right-of-way except when set out for collection. Containers may not be placed at the curb more than 24 hours before pickup and must be removed within 24 hours after. Visible storage of containers is a code violation.
Eastvale's solid waste chapter, EMC Chapter 16.05 (replaced in full by Ordinance 22-02, effective February 9, 2022), governs how trash containers must be stored and presented. Section 16.05.110(c) ("Storage") states that "except during the time a container is placed for collection, no container shall be visible from the public right-of-way." In practice this means carts must be kept in a garage, side yard, or behind a fence or wall when not out for pickup. For collection, Section 16.05.110(b) prohibits placing a container in the public right-of-way "more than 24 hours prior to the normal collection time," and requires removal "within 24 hours after collection." Items scheduled for bulky-item pickup have a tighter window: they may be placed out no more than 12 hours before the scheduled collection and must be removed and stored out of public view within 12 hours after (16.05.110(c)). The city's franchised hauler, WM (Waste Management), instructs residents to set carts at the curb with wheels against the curb by 6:00 a.m. on the collection day, keep at least three feet of clearance from parked cars, mailboxes, and other obstacles, and not overfill the cart so the lid closes. These container rules are city rules under the Eastvale Municipal Code, distinct from the statewide three-container framework that SB 1383 requires.
Leaving containers visible from the public right-of-way outside collection times, or placing/removing them outside the 24-hour windows, violates EMC 16.05.110. Violations of Chapter 16.05 are misdemeanors punishable under EMC chapters 1.01 and 8.17 (16.05.720, 16.05.730).
