Because the code reaches all premises regardless of occupancy, a vacant lot owner is responsible for preventing the prohibited public nuisance conditions the City enumerates, including dead, decayed, diseased, or hazardous trees, weeds, ground cover, and other vegetation (or the absence of healthful vegetation); lack of landscaping or approved ground cover required by the Zoning Code; and vegetation that overhangs or grows onto public sidewalks, alleys, streets, or other rights-of-way so as to obstruct people or vehicles. Accumulation of rubbish, debris, or junk that creates a nuisance is likewise prohibited on any premises. The City's Code Enforcement Division investigates these conditions and can issue notices to abate, and the City may abate the nuisance itself and recover costs. Where the City has no parcel-specific standard, the underlying state nuisance and fire-hazard weed-abatement framework also remains available, but Alhambra enforces blight on vacant land primarily through Chapter 6.26.
Nuisance conditions on a vacant lot are abatable under Chapter 6.26; maintaining a public nuisance is a misdemeanor under Municipal Code Sec. 1.12.010, and the City can perform abatement and assess costs to the owner.
