Hayward, CA Public Conduct: Aggressive Panhandling (2026)

Hayward Municipal Code Sec. 04 makes it unlawful to "solicit, ask, or beg in an aggressive manner in any public place," defining aggressive manner to include following or approaching someone in a way likely to cause fear of bodily harm, intentionally touching a person or occupied vehicle without consent, blocking pedestrian or vehicle passage, using violent or threatening gestures, persisting after being told no, or using profane language likely to provoke violence. Sec. 05 goes further and prohibits ALL solicitation, aggressive or not, within 30 feet of any bank, savings and loan, credit union, or check-cashing business entrance during business hours, within 30 feet of any ATM while it is in service, inside ATM facilities without permission, of drivers or occupants of vehicles in public places, and in any parking lot or structure "any time after dark" (defined as 30 minutes after sunset to 30 minutes before sunrise).

Solicitation is also barred inside public transportation vehicles carrying ten or more passengers. The Council's own findings, recorded in Sec. 01, cite window-washing confrontations and captive-audience solicitation at ATMs and on buses as the problems the ordinance targets, and state plainly that "no state laws address or protect the public from the problem of intimidating or aggressive solicitation," which is why Hayward wrote its own rule rather than relying on the Penal Code. The ordinance carves out sidewalk vendors under Chapter 6, Article 16 and peddlers under Chapter 8, Article 1, so licensed vending is not swept in.
