Gary, IN Public Conduct: Jaywalking (2026)

Gary Municipal Code Article IX of Chapter 40 governs pedestrian crossings. Sec. 40-473 requires that between adjacent intersections controlled by traffic signals, pedestrians must cross only in a marked crosswalk, and once in a crosswalk a pedestrian must move on the right half of it whenever practical. Sec. 40-474 addresses mid-block and unsignaled crossings: any pedestrian who crosses a roadway at a point other than within a marked crosswalk, or within an unmarked crosswalk at an intersection, must yield the right-of-way to every vehicle on the roadway rather than the reverse.

The article works together with Sec. 40-475, which protects a pedestrian already using a marked crossing or an unmarked crosswalk at an intersection: once a vehicle has stopped there to let a pedestrian cross, the driver of any other vehicle approaching from the rear may not overtake and pass the stopped vehicle. Sec. 40-476 further requires a pedestrian to use an adjacent sidewalk when one is provided and practicable, and, where neither a sidewalk nor a shoulder exists, to walk as near as practicable to the outside edge of the roadway, facing traffic on the left side of a two-way street.

These sections trace to Ord. No. 3160 (1954) and track the state pedestrian statutes at IC 9-21-17, but they are enacted as the city's own Chapter 40, Article IX. Gary Police Department officers enforce the article on city streets.
