Milpitas, CA Public Conduct: Jaywalking (2026)

Section 9 of Milpitas' traffic chapter governs pedestrians, and § V-100-9.02 sets the City's jaywalking rule directly: a pedestrian may not cross a roadway anywhere except by a route running at right angles to the curb, by the shortest straight route to the opposite curb, or within a marked crosswalk. The City Manager or a designee establishes and maintains those marked crosswalks at intersections and other locations under § V-100-9.01. The pedestrian rules sit inside the same chapter as Milpitas' general traffic penalty clause, § V-100-1.02, which makes violating any provision of Chapter 100 a misdemeanor rather than a simple infraction, unless a later section of that chapter carves out a different penalty, as Section 10 does for parking violations, which are civil penalties under § V-100-10.01.

Because Section 9 contains no such carve-out, an unlawful mid-block or diagonal crossing under § V-100-9.02 is punishable under the Chapter 100 misdemeanor clause rather than the lighter civil-citation track used for parking. The same Section 9 also bars standing in a roadway outside a safety zone or crosswalk if it interferes with traffic (§ V-100-9.03), and bars walking off a designated walkway once the City Manager has posted signs restricting pedestrian travel in a subway, tunnel, or on a bridge or viaduct (§ V-100-9.04).
