Sec. that is plainly audible either inside another person's dwelling or at fifty feet or more, when that noise comes from a gathering of ten or more people, is a violation regardless of the noise source itself, whether it is voices, music or amplified sound. This sits alongside the general plainly-audible device rule in Sec. 16-6(a)(5) and the numeric property-boundary limits of Sec. 16-4 (55 dBA nighttime in residential zones), giving deputies three overlapping tools to cite a loud party. Sec. 16-6(b) carves out exceptions for bona fide parades, sporting events, school-sponsored activities, religious gatherings, and events under a required chapter 28 use permit, but a private residential party does not qualify.

Sec. 16-2 makes any unspecified chapter 16 violation a class 2 misdemeanor, and because Sec. 16-6 does not name a host separately from other violators, the person creating or permitting the noise, which can include a property owner or tenant who allows the gathering to continue, is the one charged. Sec. 1-11(d) allows a continuing party to be cited as a separate offense for each night it runs past curfew, and Sec. 16-5 lets the county administrator issue a limited written exemption on a hardship showing.
