Leominster, MA Public Conduct: Loud Party Ordinance (2026)

Section 14-8(3)(f) of the Leominster Code of Ordinances targets noise from gatherings of people rather than machinery. , no person or persons may disturb the peace by causing or allowing unreasonable or excessive noise, expressly including noise from an electronic device, a band or orchestra playing, or excessive outcries, exclamations, or loud singing by a person or group of persons. The section defines unreasonable or excessive noise objectively: ten dB(A) or more above the background level, measured no closer than the residential lot line or the nearest affected dwelling unit, so a complaint does not turn on an officer's subjective judgment alone.

A performance, concert, establishment, band, group, or person holding a valid license or permit from a city department, board, or commission is exempt from this restriction, which is what lets a permitted outdoor event run late while an unpermitted backyard party cannot. The Director of Public Health and Leominster police officers enforce the chapter and may require a third-party acoustical consultant to confirm a measurement. c. 40, section 21D rather than through criminal prosecution.
