Full Breakdown

c. 138, section 1, while on a public way, on a way to which the public has a right of access as invitees, in a park or playground, or on private land or a private place without the consent of the owner or person in control of it. That last clause matters: the ban reaches private property too if the person present does not have the owner's permission to drink there, not just public streets and parks. Any alcoholic beverage or container being used in violation of the section is seized and held safely until the underlying charge is finally adjudicated in court, and disposed of as the court directs, meaning a confiscated bottle is not simply returned once a case closes.

The ordinance was adopted August 27, 1973 and amended June 8, 1981, and it sits in the same chapter as Leominster's noise, littering, and enforcement provisions, chapter 14 of the Revised Ordinances covering offenses generally.

Violations & Fines

Any person who violates section 14-14 is punished by a fine not to exceed one hundred dollars for each offense, and the seized alcohol or container is held pending final adjudication of the charge and then disposed of as directed by the court.
