Southaven, MS Public Conduct: Loud Party Ordinance (2026)

Southaven Code § 10-12 targets gatherings at a residence where loud or unruly conduct occurs at the residence or within two hundred (200) feet of it and threatens or interferes with public health, safety or welfare, or the comfortable enjoyment of life and property. Loud or unruly conduct includes noise plainly audible at two hundred (200) feet or more from the building or beyond the property limits, whichever is farthest, along with obstructing a street or sidewalk, public intoxication, serving or possessing alcohol as a minor, fights and disturbances of the peace, vandalism, litter, public urination or defecation, and trespassing. For this section a minor is anyone under twenty-one (21) years of age.

Loud or unruly gatherings are prohibited and constitute a public nuisance. The City of Southaven can abate one by all available means, including an officer's order requiring people to leave the residence, a citation to the owner, and arrest for any criminal violation. The enforcement officer is a City of Southaven police officer.

The host side is where the section bites. The responsible party is anyone who rents, leases or is in charge of the residence, or who organizes or sponsors the gathering, and the owner is whoever owns the residence. The responding officer posts a notice on the front entrance at least 8½ by 11 inches with black letters on white paper, and it is unlawful to deface it or remove it within thirty (30) days of posting. A copy goes to the owner by personal service or by mail to the address on the county's last property tax assessment roll. An owner not present during the gathering can be cited by the same routes.
